WASHINGTON: In a truly just world, instead of hearing about Michael Cohen and the violations of attorney-client privilege, Stormy Daniels would be facing a host of charges. Ranging from extortion to slander, possibly solicitation, the non disclosure agreement Daniels signed, and was paid for, was not hush money to cover a crime, ala Harvey Weinstein.
Daniels says it was consensual sex, not a sexual crime. So the minute Daniels accepted money, did it became something different? Is she violating the law?
This is not to blame Stormy Daniels. She, like the rest of us, is trying to earn a living. Of course, unlike most of us, Celebrity Net Worth, says the porn star is worth upwards of $2 million dollars. She has also raised more than $320K dollars to “pay her legal fees” on CrowdJustice.com.
The headlines the mainstream media is missing
Think of all the good things Trump must have done to become president of the United States. All the lives he must have touched in a good way. Those events that never ever get so much as a minute of media attention. The stories are many – the boy who was flown by Trump to NYC for lifesaving medical treatment. The couple whose mortgage he paid. The Marines he rescued. The bully he stopped from beating another person. The farmer’s wife who, having lost her husband was going to lose her home, until she was financially rescued by Trump.
Here are 17 instances of a citizen Donald Trump’s kindness
Sadly for Stormy Daniels, God bless her Angel’s heart, the only way she can stir up some fame is by portraying herself in a less than stellar light. By donning a scarlet letter A and talking about an affair she had. An affair, that if true, was really no more than a one-night stand between two consenting adults.
Why does Daniels think we need to hear about this. Or care?
Hell hath no fury as a woman scorned
As Shakespeare so famously said, “The lady doth protest too much, methinks.” (Hamlet)
Is Daniels campaign against Trump because her interest in the billionaire, for love or money, never materialized. Is she truly scorned, or just a jilted lover? Headlines do not portray Daniels in a positive light. We are still a Judeo-Christian culture. The number one result on google for Stormy Daniels headlines is: Porn Star who had affair with Trump.
America, at least America over 50, does not necessarily enjoy the prurient nature of Daniels career choice. They may accept her right to make that choice, but that does not make it more or less palatable.
To put that into perspective, according to a 2014 AARP article: “There are 108.7 million folks age 50-plus. This includes 76.4 million boomers (born 1946-64), compared with 49 million Gen Xers and 82 million millennials.” That same article says that the number of people over 50 will grow more quickly than the millennial generation.
And while those over 60 are, reports say, more sexually active than in the past, the overload of porn via the internet, and its easy accessibility has led to a decrease in its popularity (What Everyone Ought To Know About Porn (Is Porn Bad?).
The Story Daniels payoff and the crimes committed
Michael Cohen allegedly paid-off Stormy Daniels in an effort to keep her from talking about her one-night stand with Trump. One news outlet says that he used campaign funds. Another stated that he obtained funds through a bank loan. Both of which would be just as illegal as her threatening to go public with the alleged affair.
Under the law that’s extortion plain and simple. Any attempt to gain property or money by force or threat to someone’s reputation is a felony carrying a penalty of up to 20 years.
The story neither ads up or jives completely.
Is Stormy Daniels guilty of solicitation?
From a purely legal perspective, assuming the worst, that they had intimate relations and she is requesting or accepting payments that’s solicitation plain and simple. A first offense carries a charge of 12 months and a $2,500 fine.
Meanwhile, Trump is busting his hump negotiating trade deals with Japan, organizing a new path for North Korea US alliances, and my least favorite plan –building a wall. And ignoring Stormy Daniels. Which if her allegations are true, he has been doing for well over a decade. And may be why she is, in word, a woman scorned.
Today’s click-bait media pandering to sensationalism
Like gossiping neighbors chittering over the affairs of Mr. or Mrs. Jones, the mainstream media loves the salacious. The headline that causes the news surfer to stop, and click through to their page. Whether it is a newsworthy story or not makes no difference to the majority of news. It is the CTR, or click through rate, not news that matters.
The mistake of pandering to sensationalism is that no one ever takes the serious seriously. The things that matter to the everyday working stiff like how much he pays in taxes, will his company shut its doors and move somewhere else are blips on the radar screen.
Real stories about real people no longer matter if we can talk about the porn star and the President. A reminder, what they keep regurgitating is an alleged event over a decade old. A one night stand. A mistake. A lapse of judgement. Or an opportunity taken. Regardless, if true it hardly portrays either party in a positive light.
So is the fact that Stormy Daniels is a porn star make it more or less wrong for her to knowingly have a brief sexual encounter with a married man. It is not like she did not know who he was or that he was married. Or is the “wrong” in that she continues to try to financially benefit. How much is consensual sex worth?
We have proof, but you can’t see it
If Stormy Daniels can’t prove a relationship existed with President Trump then she is subject to a slander charge. Trump would only need to prove that her actions were malicious. Which would not be very hard to do.
Solicitation, slander and extortion. That’s at least 3 charges ranging from a misdemeanor to a felony. Stormy Daniels could face penalties of up to 20 years in total. Another inconvenient fact the media ignores. A media that has no legal compass or objective foresight. Not to mention a total disregard for honesty, unbiased reporting or integrity.
