WASHINGTON. On Sunday, some participants in the first of the so-called migrant caravans attempted to storm the US border with Mexico. They were quickly surprised and repelled when US border agents fired tear gas in their direction.
From judicial gasbaggery to teargas
You may recall that US District Court Judge Jon S. Tigar issued a by-now predictable temporary stay on President Trump’s executive order restricting asylum for foreigners entering the US illegally. The President’s move was intended to blunt any legal advantage that might be gained by the 10,000-strong migrant army currently bivouacking in Tijuana, Mexico.
But Judge Tigar’s dubious legal stay of Trump’s executive order effectively gave this and other migrant caravans the green light to ignore the president and attempt to rush the border.
Trump’s executive order and Tigar’s prompt but dubious judicial veto triggered a national debate on the American judiciary’s independence and impartiality, particularly with regard to illegal immigration and the illegal migrant caravans, the latter of which the president correctly labels “an invasion.”
It’s the president’s belief that when the administration challenges Judge Tigar’s ruling, it will do so before the very liberal 9th Circuit Court of Appeals. And so, Trump tweeted:
“You go to the 9th Circuit and it’s a disgrace. And I’m going to put in a major complaint because you cannot win – if your us – a case in the 9th Circuit and I think it’s a disgrace.”
Getting back to Judge Tigar, Trump added:
“This was an Obama judge. And I’ll tell you what, it’s not going to happen like this anymore.”
Speaking truth to the power-mad
Leave it to Trump to speak truth to real power – unelected, authoritarian judicial power. He sweeps aside the fiction that America exists under an independent judiciary unaffected by philosophical predispositions.
But the president’s usual frankness concerning the kind of legislation-happy judges appointed by his liberal and #NeverTrump predecessors did not sit well with the Supreme Court’s Chief Justice John Roberts. He’s the one, as we recall, whose deciding vote forced government-run health care down the throats of free Americans.
“We do not have Obama judges or Trump judges, Bush judges or Clinton judges. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. That independent judiciary is something we should all be thankful for.”
That, of course, is utter crap. And Trump said as much via – what else? – Twitter:
“Sorry Chief Justice John Roberts, but you do indeed have ‘Obama judges,’ and they have a much different point of view than the people who are charged with the safety of our country.”
One followup fact backing up Trump’s observations was cited by several commentators. They noted that, for some strange reason, the Chief Justice never bothered to rebuke President Obama when he trashed the Supreme Court members seated before him during one infamous State of the Union address. The Chief Justice’s comment on Obama’s unprecedented attack: crickets.
Sanctimony wrapped in black robes
Observe America’s current crop of black-robed pontificators. Seated comfortably in their marbled chambers, they preside over American citizens. Far removed from the victims of their Mount Olympus musings, they fail to connect with their fellow citizens.
Down on Earth, murder, rape and robbery of innocent Americans is its consequence. American citizens watch the current migrant caravans helplessly. Meanwhile, these liberal judges and circuit courts undermine their electoral system more effectively by them than Vladimir Putin’s Russians could ever hope to achieve.
Illegal immigration and sanctity of the voting booth
In Georgia’s Habersham County, which claims a modest 276 registered voters, a reported 670 people exercised their franchise. That represents an impossible 243 percent voter turnout.
According to the Pew Research Center, Georgia boasts an illegal alien population of 375,000, 56 percent of which hail from Mexico. It’s becoming more difficult not to roll one’s eyes as Democrats and their media mouthpieces look under every rock for evidence of Russian influence on our elections. Meanwhile they categorically deny the obvious and real threat to our nation’s electoral integrity, the stream of illegal aliens and illegal, invading migrant caravans that attack our borders 24/7.
Meanwhile down in Florida, the Sun Sentinel reported that former Broward County Supervisor of Elections Brenda…
“… Snipes acknowledged the processes her office has been using aren’t perfect and that some noncitizens and felons have voted despite not being eligible – especially right before major elections, when groups are actively registering new voters.”
And we should remember that Florida’s Republican Gov. Jeb Bush appointed Snipes to her position back in 2003. You see, the open-borders policies of Democrats and bipartisan, never-Trump Republicans represent the greatest threat to the integrity of our nation’s electoral system.
The 9th Circuit Court of Appeals: A history of reversals
Getting back to the 9th Circuit Court of Appeals, that famously out-of-sync court just might uphold Judge Tigar’s stay of Trump’s asylum order. However, from 2010 to 2015, the high court reversed 79 percent of the 9th Circuit’s rulings. That’s an astonishing figure, even given the current liberal lock on America’s courts in general. Consequently, that’s why the President and his administration are attempting to jump the 9th Circuit by requesting the Supremes hear this case directly.
Packing the courts – with constitutionalists
The GOP increased its Senate majority during the recently concluded midterms. They accomplished this despite numerous incidents of vote tampering such as those mentioned above. With their support, Trump could largely undo the efforts of “Obama judges” and the Bush family to promote illegal immigration. Above all, the GOP Senate can help him stack the courts with America First jurists.
Finally, we must dispense with the fiction that an independent and neutral judiciary protects our constitutionally guaranteed rights. If that were even remotely true, conservative Justice Brett Kavanaugh would not have been smeared as a gang rapist. Yet that was how leftist “Democrats” played the game. They initiated this scandalous and untrue stunt in a desperate attempt to preserve an activist, liberal court. Such courts routinely save them the problem of passing significant legislation – on the record.
President Trump understands this political reality, even as the disappointingly squishy US Chief Justice, a clueless George W. Bush appointee, remains unclear on the concept.
