Tracy Morgan recovery from crash, brain injury is “rough”

WASHINGTON, October 2, 2014 – Reports that Tracy Morgan is having a “rough time” in his recovery from a June 7 accident on the New Jersey Turnpike that left comedian James McNair, aka Jimmy Mack, dead

Morgan, 45, suffered a broken leg and ribs in the crash, which occurred while he and several friends were returning from a comedy gig at a Delaware casino.According to his lawyer, Benedict Morelli, Morgan suffered a debilitating brain injury in the crash and his career could be in jeopardy.

Morgan is in a rigorous rehab program than includes daily speech, cognitive, vocational and physical therapies in an attempt to get his life back.


Recent reports on Morgan’s health are that he relies on a wheelchair and it may be months before he can fully walk again. He spent more than a month in the hospital and rehab following the accident. Recent photos show Morgan using a walker and wheelchair and scars at his hairline are visible.

Attorney Morelli says “He’s making incremental progress,” Morelli says. “But they’ll have to wait another month before they assess him cognitively.”

When asked if the “30 Rock” comic will ever perform again, his lawyer, Benedict Morelli, said, “The jury’s still out. The doctors don’t know the answer. I don’t know the answer,”

Friend and Comedian James McNair was killed in the crash. Comedian Ardley Fuqua was seriously injured requiring additional surgeries and Morgan’s Assistant Jeffrey Millea were also injured when Walmart driver Kevin Roper, 35 of Jonesboro, GA slammed his Walmart tractor-trailer into the Limo van Morgan’s party was riding in.

Official reports are that Roper was driving in excess of 20 miles over the speed limit when his vehicle struck Morgan’s. Morgan’s suit, filed in July alleges that the driver fell asleep after being awake for more than 24 hours, following a 700 mile commute from Jonesboro, GA.

Roper has pled not guilty to charges of death and assault by auto, denying he fell asleep.

Morelli says memories of the crash are fuzzy, saying, “When you have a traumatic brain injury, you remember certain aspects. This isn’t unusual — it wipes away certain thoughts.”

Morgan has filed suit against Walmart, who denies liability saying that Morgan is responsibility for the gravity of his injuries, as he was not wearing a seatbelt.

“After I heard what Walmart said in court I felt I had to speak out,” Morgan said in a statement. “I can’t believe Walmart is blaming me for an accident that they caused.”

“My friends and I were doing nothing wrong,” Morgan continued. “I want to thank my fans for sticking with me during this difficult time. I love you all. I’m fighting hard every day to get back.”

In response to Walmart’s response, Morelli said:

“These people are despicable. They knew that they changed these people’s lives forever and killed somebody.”

TThey’re good blame shifters. I guess that’s how they make $783 billion a year, shifting the blame.”

The accident has also cost Morgan numerous jobs including a TV show and a movie, Morelli said. But he is doing everything he can to make a comeback.

“I love you all,” Morgan added. “I’m fighting hard every day to get back.”

“My friends and I were doing nothing wrong,” Morgan continued. “I want to thank my fans for sticking with me during this difficult time.”

Fuqua, who opened for Morgan the night of the crash, suffered serious injuries and is scheduled for surgery tomorrow. Morgan may have more surgeries in his future, too.

Morelli said the three survivors’ memories of the crash are fuzzy, saying, “When you have a traumatic brain injury, you remember certain aspects. This isn’t unusual — it wipes away certain thoughts.”

Morgan has already missed numerous jobs including a TV show and a movie, Morelli said.
