WASHINGTON, June 3, 2014 — The Obama Administration’s decision to release dangerous terrorists to obtain the return of a deserter from the Army is not just a bad decision; it is horrendous.

There are a number of reasons President Obama should not be impeached, but the Constitution calls for the impeachment of a president for “treason, bribery or high crimes and misdemeanors.”

The release of five very dangerous terrorists, without notifying Congress as required by law and in exchange for a man the administration certainly had to suspect was a deserter and possibly a collaborator is clearly a “high crime or misdemeanor.”

It is probably treason. It legitimately raises the question, whose side is Barack Obama on?

The number one defense against impeachment is Joe Biden, a man we should want behind the Resolute desk even less than we want Obama. President Biden would have all of the benefits of running for election as the incumbent, yet able to distance himself from some of the worst actions of the Obama Adminstration.

A second reason not to impeach is that Democrats would never vote to convict Obama. Even if the GOP took control of the Senate, there is simply no way they would get 67 votes to remove him.

Harry Reid would not even allow a trial in the Senate.

However, Bowe Bergdahl has changed things in a very bi-partisan way. When Obama traded the five most important Taliban prisoners to get back a man who probably deserted his unit, who very possibly collaborated with the enemy, everyone stepped back aghast.

And while we all agree that getting a U.S. soldier back, many, including soldiers serving in his platoon, have asked if the price was too high.

America is learning more about Bergdahl’s disappearance, such as before he disappeared, he mailed all of his personal belongings back to his family.

According to Fox News, he left a note behind renouncing his American citizenship.

Another report says that U.S. Special Forces had intelligence on where Bergdahl was and how many men were guarding him, but were unwilling to take the risk to recover a man who was most likely a deserter.

The actions of Robert Bergdahl, Bowe Bergdahl’s father raise questions, including his praise of Allah in Arabic in the Rose Garden and his apparent comments in a tweets four days before his son’s release:

“I am still working to free all Guantanamo prisoners. God will repay for the death of every Afghan child, ameen.”

According to Time Magazine, this was not the first time that the Obama administration wanted to release these Taliban terrorists, but the military and intelligence communities had managed to stop those earlier efforts.

Time Magazine reports that the White House ignored existing interagency processes regarding the transfer of Guantanamo Bay prisoners, dismissing “long-standing Pentagon and intelligence community concerns based on Top Secret intelligence about the dangers of releasing the five men, sources familiar with the debate tell TIME.”

The Pentagon and intelligence communities had previously fought against the release of the five men, so Obama acted alone and unilaterally to release the five terrorists the Taliban wanted back the most.

Impeachment is different from a criminal proceeding. The president enjoys immunity from lawsuit and prosecution while he is president. Impeachment is an inherently political act. The Supreme Court has said as much. Political grounds are a justification for “high crimes and misdemeanors.” The founding fathers left that term purposefully vague so that it could cover a multitude of situations.

This scandal has exploded in an unbelievably short period of time. There will certainly be hearings in the Congress over this. It is all but certain that members of the military and intelligence communities will leak damaging information over the next few months.

There remains the investigation into the actions of Bowe Bergdahl. There are already calls for his court-martial for desertion. If the Obama Adminstration does not allow the military to investigate and prosecute, it will suffer a death from a thousand cuts as those leaks continue.

If they do authorize an investigation and Bergdahl is charged, the evidence that comes out will be damning as well.

Obama is either incredibly stupid or he is working against America. It almost doesn’t matter which one is the case. Either is good enough for him to be removed from office.
